These Terms & Conditions (the "Terms") govern your access to and use of Theater of Kami (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Your use of the Service is also governed by our Acceptable Use Policy and our Refund Policy, which are incorporated into these Terms by reference and form part of your agreement with us. Our Privacy Policy explains how we handle your personal data.

1. Eligibility

You must be at least 16 years old to create an account. If you are under the age of majority (or under the age of digital consent in your country), you may use the Service only with the consent and involvement of a parent or guardian who agrees to these Terms on your behalf.

2. Your account

You register with an email address, which you confirm with a verification code. You are responsible for keeping your credentials secure and for all activity under your account. Provide accurate information and keep it up to date. One person may not maintain multiple accounts to abuse promotions or starter bonuses.

3. The Service

Theater of Kami is an AI-powered narrative role-playing game with an optional language-learning mode. Worlds, characters, dialogue, images and other content are generated by artificial intelligence and are provided for entertainment and educational purposes. The Service is provided on an "as is" basis; AI output can be unexpected, inaccurate or incomplete, and language-learning feedback is not a substitute for professional instruction.

4. Coins

The Service uses an in-game virtual currency ("coins") to access certain actions and features. Coins are a limited, personal, non-transferable license to use features within the Service. They have no monetary value, cannot be exchanged for cash, and are not a deposit, electronic money or any form of stored-value instrument. Coins you purchase do not expire while your account remains active. We may change the coin cost of features over time. Refunds are governed by our Refund Policy.

5. Subscriptions

Coin packs priced at $10 and above may be purchased as a monthly subscription. A subscription is billed at the chosen tier each month and grants you the same amount of coins each month plus additional subscriber benefits. Subscriptions renew automatically until cancelled. You may cancel at any time; cancellation stops future renewals, and your benefits and that period's coins remain available until the end of the current paid period.

6. Payments and taxes

All payments are processed by our third-party reseller and Merchant of Record. When you make a purchase, the payment processor is the seller of record: it handles the transaction, billing and any applicable taxes (such as VAT or sales tax) and your purchase is also subject to the payment processor's buyer terms.

7. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in violation of these Terms;
• generate, request, or attempt to prompt or steer the AI into generating sexually explicit, pornographic, or sexually suggestive content;
• generate content that is hateful or harassing, or that promotes or provides instructions for violence, self-harm, or serious harm to others, or graphic gore or shock content;
• attempt to create, solicit or distribute content that is illegal or that infringes the rights of others;
• harass, abuse or harm others, or impersonate any person;
• reverse engineer, decompile, scrape, or use automated systems to access the Service except as permitted by law;
• resell, rent or share your account, or circumvent the coin or payment systems;
• interfere with or place an unreasonable load on the Service or its infrastructure.

These rules are set out in full in our Acceptable Use Policy, which forms part of these Terms. We may suspend or terminate accounts that violate these rules, and inputs and AI-generated content are subject to automated moderation and review. Because the Service is single-player, content you generate is for your own private use and is not published to other users.

8. AI-generated content

Characters, conversations, images and other outputs are generated by artificial intelligence in response to your inputs and the game state. Such content may be inaccurate, offensive or unexpected. You are responsible for the inputs you provide. We do not guarantee the accuracy, appropriateness or fitness for any purpose of AI-generated output.

You must not use the Service to generate the face, likeness or voice of a real, identifiable person without that person's explicit consent — including by means of face swaps, deepfakes or other impersonations.

9. Your inputs

You retain any rights you have in the text you submit. You grant us a worldwide, royalty-free license to host, process and transmit your inputs as needed to operate the Service, including sending them to our AI providers to generate results. Do not submit content that you do not have the right to use or that is unlawful.

10. Intellectual property

The Service, including Game Packs, characters, artwork, music and the Theater of Kami name and branding, is owned by us or our licensors and is protected by intellectual-property laws. Your purchase of coins or a subscription grants a limited, revocable license to use these materials within the Service only; no ownership is transferred to you.

The characters, worlds and artwork we distribute in Game Packs are original creations generated with AI; they are not based on, or derived from, any existing third-party intellectual property.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, secure or error-free, or that AI output will meet your expectations.

12. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special or consequential damages, or for loss of data or profits. Our total liability for any claim relating to the Service is limited to the amount you paid us (or via our payment processor for the Service) in the twelve months before the claim. Nothing in these Terms limits liability that cannot be excluded under applicable law, including your statutory consumer rights.

13. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms. On termination, unused coins may be forfeited, subject to mandatory law and our Refund Policy.

14. Changes

We may update the Service and these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Your continued use after changes take effect means you accept the updated Terms.
